Terms of Use

Thank you for using stacktune. By using our services, you’re agreeing to be bound by these Terms and our Privacy Policy. If you’re using our services for an organization, you’re agreeing to these Terms on behalf of that organization.

Services

Stacktune offers services which enables users to make audio files and other content available to other users.

You may use our services only as permitted by applicable law, including export control laws and regulations. To use our services, you must be at least 13, or in some cases, 16 or even older. Please check your local law for the age of digital consent. If you don’t meet these age requirements, you may not use our services.

User Content

Our services make content available that is provided by others and is not owned by stacktune. Such content is the sole responsibility of the entity that makes it available. Correspondingly, you are responsible for your own content and you must ensure that you have all the rights and permissions needed to use that content in connection with the services. You retain ownership of your content, however by making content available you grant us the necessary and revokable rights needed to make that content available to other users on your behalf through our services. Stacktune is not responsible for any actions you or other users take with respect to your content, including sharing it publicly.

Account

Most of the provided services require to create ("register") an account. Stacktune is free to use, however some features or additional storage space are only available via a paid subscription.

Subscriptions

A paid subscription is billed once a month to your credit card. Please contact us if you require a different payment method. A subscription can be canceled at any time and will end at the end of the billing cycle. If you cancel within the first 14 days after you subscribed to a plan, we will refund the full amount you paid. If a payment fails or your subscription ends, we will keep the files that exceed your quota for 30 days. During that time access to those files might however be restricted.

Availability

We strive to provide great user experiences, however as the web is a distributed network, not every factor involved within providing a web application is under our control. Therefore we currently do not make any warranties, either expressed or implied, about the services and their availabilty. However, in case of a substantial outage, which is caused by our fault, we will reimburse the amount that is equal to the time you paid for, but were unable to use our services. In case you should encounter that our services do not work as intended, please contact us at contact@stacktune.com or through our contact form and we will do our best to resolve the issue as soon as possible.

Security

Stacktune cares about the integrity and security of the data you provide to us and uses commercially reasonable means to protect your data. However, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your data for improper purposes. You acknowledge that you provide your data to us at your own risk.

Acceptable Use

You agree to not use the stacktune services in a manner that they have not been designed for or help anyone else to do so. For example, you must not even try to do any of the following in connection with the services:

• access, tamper with, or use non-public areas or parts of the services, or shared areas of the services you haven't been invited to
• interfere with or disrupt any user, host, or network, for example by sending a virus, overloading, flooding, spamming, or mail-bombing any part of the services
• breach or otherwise circumvent any security or authentication measures
• send unsolicited communications, promotions or advertisements, or spam
• send altered, deceptive or false source-identifying information, including "spoofing" or "phishing"
• sell the services unless specifically authorized to do so
• advocate bigotry or hatred against any person or group of people based on their race, religion, ethnicity, sex, gender identity, sexual preference, disability, or impairment
• violate the law in any way, including storing, publishing or sharing material that's fraudulent, defamatory, misleading
• violate the privacy or infringe the rights of others

In case you aim to research potential security vulnerabilities or others, please contact us before taking action as we support such efforts.

Copyright

We respect the intellectual property of others and ask that you do too. We respond to notices of alleged copyright infringement if they comply with the law. We reserve the right to delete or disable content alleged to be infringing and terminate accounts of repeat infringers.

Termination

You are free to stop using our services at any time. We also reserve the right to suspend or end the services at any time at our discretion and without notice. For example, we may suspend or terminate your use of the services if you're not complying with these Terms, or use the services in a manner that would cause us legal liability, disrupt the services or disrupt others' use of the services.

Changes to the Terms of Use

Occasionally we may, in our discretion, make changes to the Terms of Use. When we make material changes to the agreements, we’ll provide you with prominent notice as appropriate under the circumstances, e.g., by displaying a prominent notice within the service or by sending you an email. In some cases, we will notify you in advance, and your continued use of the service after the changes have been made will constitute your acceptance of the changes. Please therefore make sure you read any such notice carefully. If you do not wish to continue using the service under the new version of the Terms of Use, you may terminate the agreements by contacting us through the contact form. Where applicable, we’ll offer you a prorated refund based on the amounts you have prepaid for services and your account cancellation date. By continuing to use or access the services after the updates come into effect, you agree to be bound by the revised terms.

Dispute Resolution

Customer’s satisfaction is very important to us. We want to address your concerns without needing a formal legal case. Before filing a claim against stacktune, you agree to try to resolve the dispute informally by contacting contact@stacktune.com. We’ll try to resolve the dispute informally by contacting you via email or phone if your messages contains your number. If a dispute is not resolved within 15 days of submission, you or stacktune may bring a formal proceeding.

Jurisdiction

These terms are governed by and will be construed under the laws of Germany. For all purposes of this Agreement, the parties consent to exclusive jurisdiction and venue in the state or federal courts located in Stuttgart, Germany.

Entire Agreement

These Terms constitute the entire agreement between you and stacktune with respect to the subject matter of these Terms, and supersede and replace any other prior or contemporaneous agreements, or terms and conditions applicable to the subject matter of these Terms. These Terms create no third party beneficiary rights.
